1. Introduction and Acceptance of Terms
Welcome to KP Renovation of Westchester LLC ("Company," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our site or services.
2. Services and Estimates
We provide home renovation and custom carpentry services. Any written estimate provided is an approximation of costs based on initial discussions and visible site conditions. Estimates are not guarantees and are subject to change based on actual site conditions discovered during construction, client-requested modifications, or specific material selections.
3. Client Responsibilities
Clients are responsible for providing clear and safe access to the property during scheduled work hours. Unless otherwise agreed in writing, clients are responsible for obtaining necessary permits. Timely decision-making regarding finishes and materials is essential to maintain project schedules. Failure to provide access or make decisions may result in delays and additional costs.
4. Payments, Invoices, and Change Orders
Payment terms are outlined in individual project contracts. Invoices are due upon receipt or according to the agreed-upon milestone schedule. Invoices unpaid after 30 days will accrue interest at 1.5% per month. KP Renovation reserves the right to suspend work on any project with outstanding unpaid invoices. Any deviations from the original scope of work will be documented in a written Change Order, which must be signed and paid according to the terms specified therein before the additional work commences.
5. Pre-Existing Conditions, Scheduling, Delays, and Access
KP Renovation is not responsible for pre-existing conditions not visible or disclosed prior to commencement, including but not limited to asbestos, mold, lead paint, faulty wiring, or structural deficiencies. Discovery of such conditions will be addressed via written Change Order. While we strive to adhere to projected timelines, construction schedules are subject to factors beyond our control, including weather, material availability, and sub-contractor scheduling. We are not liable for reasonable delays caused by these or other unforeseen circumstances. The client must ensure the work area is clear of personal items and debris prior to our arrival.
6. Workmanship, Materials, and Warranties
We stand behind the quality of our craftsmanship. All work will be performed in a professional manner consistent with industry standards. Materials used are subject to manufacturer warranties. Our specific workmanship warranty details are provided in your individual service contract; generally, this covers defects in labor for a limited period from the date of substantial completion.
7. Limitation of Liability
To the maximum extent permitted by law, KP Renovation of Westchester LLC shall not be liable for any indirect, incidental, or consequential damages arising out of the performance or non-performance of our services. Our total liability for any claim shall not exceed the total amount paid by the client for the specific project in question.
8. Website Use and Intellectual Property
The content on this website, including text, designs, and project photos, is the property of KP Renovation of Westchester LLC. You may not misuse, copy, or redistribute this content without our express written permission. We reserve the right to use photos of completed projects for marketing purposes unless otherwise agreed in writing with the client.
9. Governing Law & Dispute Resolution
For services performed in New York these Terms & Conditions are governed by the laws of the State of New York. Any disputes arising from services performed in New York shall first be submitted to good faith negotiation and, if unresolved, to non-binding mediation before pursuing litigation. Legal proceedings, if necessary, shall be brought to the courts of competent jurisdiction in New York.
For services performed in Connecticut, these Terms & Conditions are governed by the laws of the State of Connecticut in compliance with the Connecticut Home Improvement Act (CGS 20-418 et seq.). Any disputes arising from services performed in Connecticut shall first be submitted to good faith negotiation and, if unresolved, to non-binding mediation before pursuing litigation. Legal proceedings, if necessary, shall be brought in the courts of competent jurisdiction in Fairfield County, Connecticut.
10. Cancellation Rights
New York clients have the right to cancel within three (3) business days of signing a contract without penalty per NY GBL Article 36-A.
Connecticut clients have the right to cancel before midnight of the third business day after signing per CGS 20-429.
